New bellwether trial dates have been selected in the Paragard multidistrict litigation after the court had initially set the first trial to begin sometime last month.

The two bellwether trials, which will play a key role in determining the direction of thousands of Paragard lawsuits, will begin on Dec. 1, 2025 and Feb. 2, 2026. The court noted that those dates are pending the availability of the defendants’ counsel.

Bellwether trials essentially work as test cases that help to determine the likely outcome of trials when there are hundreds or thousands of similar lawsuits.

Before the newest schedule, the first of the bellwether cases was initially expected to go to trial by the end of October 2024. That began to look unlikely as the date approached and the MDL remained largely quiet, with few new major court document filings.

Why Paragard Lawsuits Are Being Filed

Plaintiffs have filed Paragard lawsuits over claims that defendants failed to warn of risks associated with the removal of the IUD. The devices are designed to last up to 10 years and the removal process is typically a minor procedure.

But lawsuits have claimed that parts of the devices have broken off during the removal process, leaving those pieces lodged in the uterus of patients.

Some cases have claimed that the breakage has resulted in pain, the need for surgery and even infertility.

A National Institute of Health case study looking into reported cases of IUD fractures evaluated a case where a woman decided to have a Paragard IUD removed after 10 years.

While the doctor was removing the IUD, the right wing of the device broke off and remained lodged inside the patient, who then required a hysterectomy to safely remove the piece.

There are currently 2,824 Paragard lawsuits pending within the MDL.
